HiPass Design LLC (“HiPass,” “we” or “us”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy.  This Privacy Policy describes the types of information we may collect from you when you visit our website www.samialert.com or use our mobile applications (collectively, the “Site”), how we use the information we collect, and with whom we share such information. 

INFORMATION WE COLLECT

We may collect personal information from you, meaning information about you that can uniquely identify you such as your name, email address, and mailing address, if you choose to provide us with such information. 

In addition, when you visit the Site, we may collect certain information by automated means, such as cookies.  A “cookie” is a text file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser.  We may also use third-party website analytics tools (such as Google Analytics) that collect information about user traffic on the Site.  In addition, we may include single pixel .gifs, also called web beacons, in emails we send.  The information we may collect by automated means may include, but is not limited to, the following:  

  • information about the devices you use to access the Internet (such as the IP address and the type of the device, operating system, email client, and web browser);
  • dates, times, and duration of visits to the Site (including whether you are a repeat or first time visitor);
  • information about whenyou open our emails and links you follow; and
  • information regarding actions taken on the Site (such as page views and site navigation patterns).

You may create audio and video recordings using a camera in connection with our mobile applications. Such audio and video recordings are stored on your camera and/or in the associated iOS app.  We do not have access to these recordings unless you send them to us.  If you need to return a camera you have purchased from us please erase or remove the camera’s microSD memory card prior to return.

HOW WE USE THE INFORMATION WE COLLECT

We may use the information we obtain about you to:

  • provide products or services you request;

  • understand your needs and interests and tailor the Site and our products and services accordingly;

  • respond to your questions and comments and provide customer support;

  • communicate with you about our products and services and our offers, events, and promotions;

  • operate, evaluate, and improve our business and the products and services we offer;

  • enforce our Terms of Use and other agreements; and

  • comply with applicable legal requirements and industry standards.

In addition to the uses described above, we may use the information collected through automated means to identify visitors and measure the performance of our email campaigns.  We also may use the information we obtain about you in other ways for which we provide specific notice at the time of collection.

PAYMENT INFORMATION

If you make a purchase on the Site using a credit or debit card, our third party payment processors may collect your credit or debit card number, expiration date, and other payment details (collectively, “Payment Information”), as well as other personal information, in order to complete your purchase.  Our current payment processors are PayPal and Stripe.  Please be advised that we do not store any Payment Card Information.  We are not responsible for our third party payment processors’ use of any Payment Card Information or other personal information they collect in connection with your transactions on the Site.  Please review Stripe’s privacy policy (available at www.stripe.com) and PayPal’s privacy policy (available at www.paypal.com), as applicable, prior to making a purchase on the Site using a credit or debit card.

INFORMATION WE SHARE

We do not share your personal information with third parties except as described in this Privacy Policy.

We sometimes use third party service providers to perform specific business functions on our behalf.  When we disclose information to these service providers, we disclose information to help them to perform their service.  For example, if you order products on the Site, we may provide shipping companies with personal information such as your name, mailing address, email address, and phone number in order to deliver products to you. 

In addition, we may disclose your personal information to: (i) comply with any court order, law, or legal process, including to respond to any government or regulatory request; (ii) enforce or apply our Terms of Use and other agreements; and/or (iii) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of HiPass, our customers, or others.  We also reserve the right to disclose your personal information to a buyer or other transferee in the event of a merger, divestiture, restructuring, reorganization, dissolution, sale, or other transfer of some or all of our assets.  Should such a sale, merger, or transfer occur, we will use reasonable efforts to direct the transferee to use your personal information in a manner that is consistent with this Privacy Policy.

YOUR CHOICES

We offer you the following choices about what information we collect from you and how we communicate with you: 

Cookies.  Most browsers allow you to turn off the use of browser cookies by changing your specific browser settings.  Please note, however, that without cookies you may not be able to take full advantage of all of the Site’s features.

Marketing Emails.  If we have sent you a marketing email, you may choose not to receive additional marketing emails from us by following the unsubscribe instructions contained in each email.

Web Analytics. You may opt-out of the aggregation and analysis of data collected about you on our Site by our web analytics vendor by visiting https://tools.google.com/dlpage/gaoptout and downloading and installing the Google Analytics Opt-out Browser Add-on.

ACCESSING AND CORRECTING YOUR INFORMATION

CHILDREN UNDER THE AGE OF 13

The Site is not directed to, and HiPass does not knowingly collect or solicit personal information from, children under the age of 13.  If we learn we have collected or received personal information from a child under the age of 13, we will delete that information.  If you believe we might have any information from or about a child under the age of 13, please contact us at info@samialert.com.

CHANGES TO OUR PRIVACY POLICY

We reserve the right to update or change this Privacy Policy at any time.  If we make a material change to our Privacy Policy, we will indicate on the Site that our privacy practices have changed and will provide a link to the new policy.  In the event we make a material change to how we use your personal information, we will provide you with an opportunity to opt out of such new or different use.  The date this Privacy Policy was last revised is at the top of this page.  You are responsible for periodically reviewing the Site and this Privacy Policy to check for any updates or changes.

MESSAGING SERVICE PRIVACY POLICY

This Messaging Service Privacy Policy explains how Sami - the sleep activity monitor (hereinafter, "Sami - The Sleep Activity Monitor," "We," "Us," "Our") collects, uses, and shares personal information about you in relation to Our text message marketing program (the "Messaging Service"). This Messaging Service Privacy Policy supplements Our Primary Privacy Policy. For more details, see the section titled "Primary Privacy Policy" below.

Changes to the Messaging Service Privacy Policy
We may revise this Messaging Service Privacy Policy from time to time in our sole discretion. If there are any material changes to this Messaging Service Privacy Policy, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Messaging Service Privacy Policy if you continue to use the Messaging Service after the new Messaging Service Privacy Policy takes effect.

Personal Information We Collect
When you sign up for the Messaging Service, We collect personal information such as your name, phone number, and email address. When you use the Messaging Service to send or receive messages, We collect communications metadata (e.g., the time/date a message was sent or received) and the contents of any communications you send or receive via the Messaging Service.

We may also collect information about you using cookies or similar technologies on Our website or other digital properties. Cookies are small text files placed on device browsers that store preferences and facilitate and enhance your experience. Cookies enable personalization of your experience via the Messaging Service (e.g., sending you personalized text messages such as shopping cart reminders).

If you participate in a contest, sweepstakes, research study, or email survey associated with the Messaging Service, We will collect basic contact information and any other information you choose to provide in connection with these activities. Accurate Information
When you complete forms online or otherwise provide Us information in connection with the Messaging Service, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If, in Our sole discretion, We believe that any such information is untrue, inaccurate, or incomplete, or you have opted into the Messaging Service for an ulterior purpose, We may refuse you access to the Messaging Service and pursue any appropriate legal remedies.

Choices and Controls
Text messages may be sent via an automatic telephone dialing system. Consent to receive automated marketing text messages is not a condition of any purchase. You can opt-out of receiving further commercial text messages via the Messaging Service by responding to any of Our text messages with any of the following replies: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT.
